Last year, the state issued two Total Wine stores one-day license suspensions for selling Smirnoff vodka and Bacardi rum at prices $1 to $6 below wholesale, violating state alcohol laws designed to curb predatory pricing. Total Wine sued in an attempt to overturn these suspensions on grounds that its prices actually fell below wholesale costs due to volume discounts from distributors for larger orders with prompt payments.

Suffolk Superior Court Judge Robert B. Gordon upheld Total Wine’s compliance with the law and determined it had legitimately passed along savings from wholesale purchases at retail to customers, as well as not ruling on its claim that state minimum pricing laws are unconstitutional.

Total Wine allows customers to return unwanted purchases within 30 days with proof of purchase and valid ID, and provides same-day local delivery in certain states that allow alcoholic beverage shipment. Shipping fees are calculated based on order weight and desired speed.
